Claiming Funds Held by the Court

How do I claim funds held by the court?

If you believe you, or a person for whom you are a legal guardian or representative, is entitled to all or a portion of funds held by the Sacramento Superior Court, you must submit an Unclaimed Funds Packet to claim the funds.

Claimants may submit completed claim forms to via the Unclaimed Funds email address at UnclaimedFunds@saccourt.ca.gov or by postal mail to Sacramento Superior Court, Attention: Accounting Unit, 720 Ninth Street, Room 20, Sacramento, CA 95814.

Unclaimed funds will remain in trust to be claimed for at least three years and six months, after which the court may issue a Notice of Intent to Escheat Unclaimed Funds Held by the Court, pursuant to Government Code §68084.1. Escheatment is the process of transferring ownership rights in property to a court when the property has no known owner, the owner cannot be found, or the owner has refused to accept the property.

Whether or not a Notice of Intent to Escheat Unclaimed Funds Held by the Court has been issued, after three years and six months, claimants must submit a letter addressed to the attention of the Sacramento Superior Court’s Executive Officer at 720 Ninth Street, 6th Floor, Sacramento, CA 95814, requesting the unclaimed funds be returned. Important: Once funds have been escheated to the court, it is at the discretion of the Court Executive Officer to accept or reject the request. Therefore, submitting an Unclaimed Funds Packet before the funds are escheated to the court is optimal.

The Unclaimed Funds Packet must be completed in its entirety; incomplete, modified, and/or illegible forms will not be accepted or processed. Claimants are encouraged to utilize the Checklist for Filing a Claim, included in the packet, to ensure the forms are complete before submitting them to the court.
