Exhibits are documents or objects produced by a party in an action for identification and may be admitted into evidence during a trial or hearing. Once the trial or hearing is concluded, the court may order the exhibits to be released to counsel or self-represented parties, or parties may stipulate to the return of exhibits pursuant to Code of Civil Procedure section 1952, or Penal Code sections 1417 through 1420.

Criminal Exhibits

Exhibits are documents or objects produced by a party in an action for identification that may be admitted into evidence during a trial or hearing.

The State of California’s Laws pertaining to exhibits can be found on the California Legislative website at California Codes: Codes Tree - Evidence Code – EVID.

For information on the requirement to submit photographic records in lieu of non-documentary physical evidence, refer to Local Rule 10.64 and Penal Code section 1417.3.

Once the trial or hearing is concluded, the exhibits may be retained by the court, or the court may order the exhibits released to the parties pursuant to a stipulation. Generally, 60 days after the final determination of a criminal action or proceeding, the clerk of the court will dispose of all exhibits introduced or filed in the case and remaining in the clerk’s possession, as referenced in Penal Code section 1417.5.
